What Regulations Govern Seafood Safety and Quality in the U.S.

Food safety and quality of seafood products in the U.S. are well regulated by a well-established regulatory framework. With the increase in the consumption of seafood products and the subsequent increase in the import of seafood products into the country, the regulatory bodies are playing a very important role in maintaining the quality of seafood products and ensuring that the seafood products are free from contamination, fraud, and mislabeling.

For a deeper market perspective, see the U.S. Seafood Market analysis.

Understanding the Regulatory Framework

The seafood industry of the U.S. is mainly regulated by the FDA. It is responsible for ensuring the safety of most seafood products in the country. This responsibility is discharged under the Federal Food, Drug, and Cosmetic Act. The FDA ensures that seafood products are processed, stored, and handled under sanitary conditions and are free from any harmful contaminants like bacteria, toxins, and chemicals.

Recently, in March 2026, the FDA was seen playing an active role in ensuring public safety in seafood products. On March 9, 2026, the FDA released a nationwide advisory and recall of oysters and clams due to possible norovirus contamination. The recalled seafood was distributed in various states in the country.

Import Controls and Traceability

Seafood imports are very vital in ensuring that the demand for seafood is met in the U.S. Thus, in this context, import regulations are very critical. The FDA is responsible for regulating imported food. It does so through the Foreign Supplier Verification Program (FSVP), which ensures that food imported into the country is from a supplier who complies with food safety regulations in the U.S. This means that all food, regardless of its country of origin, is of high quality.

For instance, in June 2025, the FDA sent a warning letter to Xin Ao International Group Corp. due to non-compliance with regulations regarding food imported into the country. The FDA claimed that the importer failed to perform verification activities to ensure that food imported into the country met food safety standards in the U.S.

Labeling and Consumer Transparency

Another significant aspect in seafood regulation is labeling. The current regulation in the U.S. market guarantees proper labeling in seafood products, including species, country of origin, and type of production, which includes either wild or farm-raised. This guarantees that consumers are able to make the right purchasing decisions and are protected from any possible mislabeling, which was a problem in seafood products.

The introduction of the Food Safety Modernization Act has strengthened the seafood regulation system, and this is because the focus is no longer on response actions but rather on preventive actions. The FSMA gives the FDA more authority in conducting inspections and responding to possible food safety risks.

Ensuring Safety Across the Supply Chain

The state and local governments add to this framework by conducting inspections and enforcing health regulations at the retail and food service levels. This is a layered system, and this ensures seafood safety is maintained at every step, from harvesting to processing, and finally, to the end consumer.

Final Thoughts

The seafood industry in the U.S. is regulated by a complete and well-coordinated system, and this is especially true with regards to safety, quality, and transparency. With the combined efforts of federal agencies, preventive systems, and stricter import monitoring, the U.S. is able to provide a consistent seafood supply to its end consumers. As the seafood industry continues to rise in terms of demand, these regulations will prove to be vital.
